Rules & Conditions

Article 1 - Orders: any contract for sale of materials between the company and any customer automatically entails the full support of the latter under the following conditions. All clauses unless otherwise agreed that will be inserted by our clients in their received or receivable letters, orders… will be null and void, without the need of protest on our part. The commitments made by our representatives will be valid only after confirmation of orders by the company TAM.

Article 2 - Delivery and transfer of risks : our products travel at the sendee's risks, even if the price is carriage paid. They are sold, taken and made payable to Lyon, without exceptions, whatever the mode of recovery. The damage, total or partial loss, missing products, recorded on delivery cannot give rise from the sendee to any dispute with the seller. The delivery dates brought on our documents are only indicative and do not give right, whatever the reasons for the delay, to cancellation of orders or compensation whatsoever for all sorts of suffered damage.
Shipping: we proceed to two shipments a week, COLISSIMO MONITORING against signature upon delivery. The package is shipped in the weeks following the receipt of the order as soon as possible. TAM SURPLUS cannot be held liable for any longer delays from circumstances beyond our control, the post guaranteeing a deadline of 48 hours of care packages.

Article 3 - Price applicable to the catalogue : TTC net prices including VAT at the rate of 19.60% for all items except books submitted at a rate of 5.50%. The price for this rate are consistent with the supply conditions known and approved so far for both articles of domestic production as of import. In case of change in prices due to increases approved for the materials or French articles or changes in the Euro parity with foreign currencies, the difference will be written on the invoice.

Article 4 - Back and claim means that any claim for delivered goods, either in quantity or quality, should be made in writing (e-mail, fax or mail) and arrive within eight days after delivery. After this time, the responsibility of TAM will be completely cleared. Any return of goods must be formally agreed by TAM, otherwise it will be kept by the buyer without any credit or refund .
Exchange of articles: Except error of our making, shipping for the return of goods and for the return of (s) the exchanged article (s) will be borne by the buyer.

Article 5 - Photographs: The photos shown on the pages of this site are not binding. The product may come photographed of different origins, and as such differ slightly from the picture presented on the site, it being understood that the product will be similar in appearance and quality.

Article 6 - Payment terms: advance payment by credit card, check, bank transfer, or against-refund (in the latter case charges against repaid shall be borne by the buyer and will be added to the bill).

Article 7 – Late payment charge : Any late payment will be payable with delay penalties from the expiry of the due date of payment. The amount will be calculated by the application, to the amount owed, of a rate equal to 1.5 times the legal interest rate in force, a day late. Besides, any late payment will entail by right the suspension of the execution of orders.

Article 8 - Jurisdiction: all disputes concerning the interpretation or execution of these are within the competence of the Tribunal de Commerce de Lyon, even in case of multiple defendant or introduction of third party.

Article 9 – Title Retention Clause : our company remains the owner of the goods delivered to the customer as the amount of bills relating thereto has not been fully resolved. For the application of this clause, the goods still in stock at the customer's and in state of being sold will be those conventionally alleged unpaid and the manufacturer will be able to take them back as compensation for all amounts of unpaid bills. This clause does not prevent the risk of goods being transferred to the customer, from the manufacturer's factory. In the event of non compliance by the customer of one or several payment deadlines, TAM SURPLUS may impose on the defaulting customer payment against repaid of all ulterior orders or stop all deliveries as long as a bill has not been fully resolved, or even after formal notice by registered letter not followed up within 8 days after receipt, cease all trade relations with the defaulting customer. In case of initiation of a procedure for receivership or liquidation of assets, the pending orders will automatically be cancelled and our company reserves the right to reclaim the stock, as provided by the Act of May 12, 1980 , as amended by the Act of June 10, 1994.

Article 10 - Counterfeiting: In accordance with the laws in force, it is prohibited to the buyer, under penalty of prosecution to reproduce in whole or in part, the models that he or she has purchased or that he or she has seen. It is also prohibited to transmit information allowing the total or partial reproduction of our models, without being guilty of complicity in counterfeiting. No return of goods cannot be done without the agreement of TAM.

Article 11 - Availability: The words "available" and "unavailable" in the article are detailed theoretical and are mentioned with reservation of physical inventory verification. TAM SURPLUS cannot be held liable for any stock unreported on the site. All our supplies are likely to hazards, particularly concerning the imported products. If a command may not be fully honoured in suitable time, the company TAM will reimburse the items not delivered simultaneously to the partial delivery.

Article 12 - Sales to minors: unless otherwise stated, the sales of all items listed under the headings "knives", "security" fire ... " is prohibited to minors under 18. Sending an order, by all means on these items, means that the buyer is major. The company TAM cannot be held responsible for the failure to comply with regulations by the buyer. The command of the above-named items is therefore supposed to be done by adults or their legal representatives (parents, guardians) for minors. Article 13 - Shipping Charges: The charges are automatically calculated depending on the weight of the articles. The applied rate is the one of THE POST. Shipments are "COLISSIMO MONITORING" (against signature)
